In 2019, a small group of legislators attempted to get kratom banned in Pennsylvania. Thankfully, their bill was quickly shot down after pro-kratom consumers, companies, and organizations stepped in to show their support for this plant.

In 2022, Pennsylvania voted in overwhelming favor of HB 2357. This bill prohibits the sale of kratom to anyone under the age of 18 years old. In what remains a series of puzzling choices, legislators removed many of the additional regulations in this bill that would make kratom safer for consumers.

Then, in 2023, State Senator Tracy Pennycuick introduced SB614. SB614 includes legislation aiming to prohibit any mixing of potentially harmful ingredients into kratom. However, as of this writing, this bill has yet to be enacted.

Will Kratom Stay Legal in Pennsylvania?

For the time being, kratom’s future looks to be safe. As of now, Pennsylvania appears to be inching closer to becoming the next state to enact a Kratom Consumer Protection Act (KCPA). 

This legislation would introduce additional regulations for companies offering kratom in this state. The KCPA protects consumers by ensuring they have access to high-quality and lab-tested kratom products. If passed, the previously mentioned SB614 bill would implement many KCPA-related kratom regulations.
