New Hampshire’s state motto is Live Free or Die. Lawmakers have upheld these values in regards to kratom. Is it legal? The simple answer is yes but with one or two important caveats.
There’s a common misunderstanding regarding a law in New Hampshire concerning kratom and its accessibility to adults only.
This confusion originated from a 2016 state Senate bill to restrict kratom sales and consumption exclusively to those over the age of 18. This proposal aimed to prevent minors from purchasing or consuming kratom by holding manufacturers and retailers accountable but it did not advance into law.
Organizations dedicated to kratom advocacy, such as the American Kratom Association (AKA), often endorse such age restrictions. The AKA, for instance, has actively promoted regulations to confine the use of kratom to adults within the framework of the Kratom Consumer Protection Act (KCPA) legislation that has been enacted in several states, including Utah, Georgia, and Oregon.
In 2021, there was consideration by New Hampshire lawmakers to adopt the KCPA, which would not only restrict use to adults but also enforce strict quality control on kratom products. Regrettably, this initiative did not progress into law.
Consequently, it is crucial for consumers in New Hampshire to be vigilant when buying kratom, ensuring purchases are made from reputable suppliers known for their commitment to offering natural, lab-verified kratom from ethical sources in Southeast Asia.
While kratom remains legal throughout New Hampshire on a statewide basis, there exists an exception at the local level. Specifically, Franklin, New Hampshire’s City Council, made a unanimous decision in 2019 to prohibit kratom within the boundaries of their jurisdiction.
Therefore, residents and visitors of Franklin, located in the heart of New Hampshire, must venture beyond the city’s borders to buy and use kratom.
Kratom is not currently listed as a controlled substance by the DEA, although it is considered a “drug of concern.” Because of this, it is not federally regulated.
This means that it is technically legal at the federal level, however, different states have varying regulations on the possession and consumption of kratom. Several US states, counties, and cities have banned kratom completely from being used, sold, or possessed.
Kratom in New Hampshire is poised to maintain its legal status, providing a solid environment for users and merchants.

Anticipated regulatory measures could mandate detailed labeling on kratom packages, outlining precise ingredients and alkaloid levels, to guard against impure products.
Introducing financial penalties and enhanced regulatory monitoring aims to curb unethical practices among kratom vendors, prioritizing the well-being of consumers.
