The latest attempt to regulate kratom in Michigan comes from House Bill 4061, which was introduced in early 2023 and has not yet advanced through the legislature. This consumer protection act would limit vendors from selling kratom unless they are appropriately licensed to do so. Additionally, kratom would be illegal for anyone under the age of 21 to purchase, possess, or consume.

The American Kratom Association is the largest kratom industry group, and they consistently advocate for FDA regulation of their products. This is because they care about their consumers and the quality of the kratom they purchase.

The AKA wants to protect consumers from unethical vendors who would sell dangerous, low-quality, inconsistent, or improperly labeled kratom products to unsuspecting buyers. If kratom is regulated, all vendors will be required to abide by certain standards related to the manufacturing and marketing of kratom.

Kratom Consumer Protection Act

Michigan is considering its own Kratom Consumer Protection Act because the federal Kratom Consumer Protection Act (KCPA) has not yet been successful.

Arizona, Georgia, Nevada, and Utah have already passed these laws, and Michigan could be the next.
