Is Kratom Legal in Illinois? Latest State Laws and Updates

Is Kratom usage legal in Illinois?

Kratom is legal in most of Illinois, for anyone age 18 and over.

Illinois residents who want to purchase kratom need to be aware of where it is legal so that they can legally and responsibly buy it. The good news is that kratom is legal in most of Illinois, other than a few specific municipalities that have banned it. The only people who are unable to purchase kratom statewide are minors.

You can find kratom at a variety of Illinois shops, some of which carry better kratom than others. Even so, you may prefer to shop online because online vendors can give you access to higher-quality kratom and better prices.

You don’t have to be limited to what your local store has in stock. Rather, you can find exactly what you’re looking for online–in the right quantities, serving sizes, and prices.

Because kratom is unregulated in the US, including in Illinois, kratom users are responsible for carefully researching their vendors. It is best to choose a vendor who conducts vigorous lab testing and abides by meticulous manufacturing standards.

Anticipated Developments in Kratom Regulation in Illinois

There have been several attempts in Illinois to ban kratom on a state-wide level, but the only one that has been successful is the ban on kratom for people who are under the age of 18.

Additionally, some municipalities have passed bans specific to their jurisdictions:

You can also expect to see other changes to regulations about kratom in the future, including better regulation for consumer safety, the possibility of passing the Kratom Consumer Protection Act, and changes to the financial and legal responsibilities of kratom vendors.

Regulation of Kratom for Consumer Safety

Better Regulation of Kratom for Consumer Safety

Alongside other industry leaders, the American Kratom Association advocates consistently for the FDA to regulate kratom. Why would the AKA want kratom to be regulated? Because they care about the quality of kratom in the US, and they want to protect consumers from unscrupulous manufacturers who could sell low-quality or even dangerous products labeled as kratom.

Federally mandated uniformity standards would go a long way to ensure that all kratom products must adhere to minimum safety, labeling, and manufacturing standards. Without those standards, the individual consumer has to do a lot more research to make sure that their chosen product will be safe and effective.

Kratom Consumer Protection Act

In October 2023, the federal Kratom Consumer Protection Act (KCPA) was introduced to the US Senate. The bill is still in committee at the federal level, but four states have passed their own versions of this act: Arizona, Georgia, Nevada, and Utah. Some lobbyist groups continue to advocate for a similar law to be passed in Illinois.

The part of the KCPA that focuses on banning the sale of kratom to people under 18 is already in effect in Illinois.

Emphasis on Quality and Transparency

One of the most important reasons why Golden Monk and other kratom vendors want to see better regulation of kratom is because it will help with both quality and transparency.

Proposed kratom regulations could require:

  • Clear, accurate labeling on kratom products
  • Lists of ingredients
  • Labeling of alkaloid percentages
  • Cautionary health statements cautioning people at high risk of complications from kratom use

Financial and Legal Accountability for Vendors

Many kratom regulation advocates want to see stricter oversight of kratom manufacturing, and the introduction of fines for violations of minimum standards. This could deter unscrupulous kratom sellers and manufacturers from engaging in dishonest, unethical business practices that put kratom users at risk.

Ideally, these future changes to kratom regulations will safeguard kratom users in Illinois–while still maintaining the plant’s legal status and accessibility.

Is kratom legal in my state?

In the US, there are no federal laws about kratom. Rather, each state has had the opportunity to regulate kratom or not. Kratom is legal in most states, although some states do have restrictions. In Illinois, there are no statewide restrictions other than limiting the sale and use of kratom to people 18 and over.

If you plan to travel with kratom, it is important to find out the laws of the states where you will be traveling.

Does kratom have any unwanted effects?

Using kratom responsibly should prevent serious unwanted effects. New users should start with a small serving size and monitor their response before advancing to a larger serving size or new variety. If you experience unwanted effects while taking kratom, you may choose to discontinue its use, try a different form, or reduce your serving size.

If you take too much kratom than your body can handle, you may experience issues like dry mouth, constipation, nausea and vomiting, dehydration, and drowsiness. People who misuse kratom for a long time can experience skin problems, changes in weight and appetite, and sleep problems. Consult a medical professional if you have questions about using kratom.

How do you choose a high-quality kratom?

Choosing a high-quality kratom product means paying close attention to the vendor, manufacturer, and even grower. Although we all love to find a good bargain, the cheapest option may not always be the best. Do your research and choose a company that you feel confident about–not just whatever random vendor your local store has in stock!
