The AKA’s goal is to protect kratom users from unethical kratom vendors who put profit before safety. Kratom vendors who sell low-quality, inconsistent, or improperly labeled kratom should be barred from selling what should be a consistent and effective substance. 

FDA regulation would lead to:

  • Quality control standards
  • Labeling requirements for manufacturers
  • Testing and certification standards
  • Educational campaigns for the risks and benefits of kratom 
  • Enforcement actions against unethical manufacturers 

Although the kratom industry supports FDA regulation, no one really knows when this could occur. Ideally, it will be within the next few years, but the timeline will depend upon many factors, including the response time of the FDA. 

Kratom Consumer Protection Act

Even if the FDA doesn’t regulate kratom anytime soon, the Kratom Consumer Protection Act could become federal law. Alternatively, Delaware legislators could pass a KCPA in the state. 

Arizona, Georgia, Nevada, and Utah have already passed KCPA laws, which protect kratom users’ access to kratom. Some KCPA legislation limits kratom’s sale to people who are at least 18 years old. 

There does not appear to be any traction in Delaware for a state-based KCPA.
