Guests and visitors to the beautiful state of West Virginia will be pleased to learn that the purchase and possession of kratom is 100% legal. While kratom is available to all adults in the state who want to experience and benefit from “Nature’s Cheat Code,” there are some lawmakers who are attempting to hinder its use. This fact stresses the importance for kratom users to stay informed on the topic.
The Future of Kratom in West Virginia
Kratom advocates are fighting on a national level to keep kratom legal for all adults. However, they also favor setting some guidelines regarding its sale. On a more local level, in 2023, Senators from West Virginia introduced Bill 220, the West Virginia Kratom Consumer Act. It adds some regulations to the sale of kratom. However, this isn’t necessarily a bad thing.
The West Virginia Kratom Consumer Act regulates the preparation and sale of kratom. Specifically, it states that:
- Kratom vendors, manufacturers, and processors must maintain a valid state permit
- Kratom samples must undergo purity testing at a certified third-party laboratory
- Kratom can only be sold to those 21 years of age or older
Advocates, like the American Kratom Association (AKA), are not only at the forefront of keeping kratom legal for adults but also advocate for its safe use, employing safety regulations and prohibiting its sale to minors. Product purity is also of importance, and they support regulations that prohibit the sale of adulterated kratom products.
Fortunately, there is no proposed future legislation to limit or ban the sale of kratom in West Virginia. Visitors and residents of the state, as long as they are 21 years of age or older, visitors and residents of the state have the freedom to experience this “octane for the soul” without fear of repercussions. However, fans of kratom should stay up to date on its future as a legally purchased product.
The Benefits of the West Virginia Kratom Consumer Act
For the kratom industry and its audience, the West Virginia Kratom Consumer Act is a big step towards its protection. While at first glance, it may seem like any kratom regulations could lead to its demise, it’s actually the opposite. This act is beneficial by:
- Keeping kratom unadulterated
- Encourages its safety
- Ensures that only adults can purchase it
- Legitimizes its benefits
- Guarantees that kratom products are lab-tested
