Kentucky passed KCPA just before Maryland, and it is hoped that Pennsylvania and New Jersey will soon follow suit.
Maryland KCPA Details
In Maryland, if a bill is not vetoed within 30 days after being presented to the governor, it automatically becomes law. Since the governor neither signed nor vetoed it, the Maryland Kratom Consumer Protection Act will take effect on October 1, 2024.

FDA Recognition
Kratom products not recognized as dietary ingredients or approved drugs by the U.S. Food and Drug Administration (FDA) cannot be manufactured, distributed, or sold in Maryland.

Kratom products must be free from adulteration or contamination with harmful substances. They cannot contain compounds that, when combined with kratom, pose a risk to consumers.
Additionally, the level of 7-hydroxymitragynine in kratom products must not exceed 2% of the total alkaloid content, and synthetic alkaloids are prohibited.
Labeling and Marketing Requirements
All kratom product labels must clearly list the amounts of mitragynine and 7-hydroxymitragynine present. Products cannot display imagery or iconography appealing to minors, nor can businesses advertise therapeutic benefits of kratom products.
Age Restrictions
Selling kratom to individuals under 21 will be illegal in Maryland going forward. The law also bans marketing, labeling, and advertising that targets minors.

Violations of the new regulations can result in fines ranging from $1,000 to $5,000 and potential imprisonment, depending on the severity of the infraction.
