Earlier this year, state lawmakers proposed legislation that would render kratom illegal at a state level. While the bill had its share of detractors, overwhelming bipartisan support was enough for the bill to pass through the Mississippi House.

According to Senate Bill 2403, AKA The Mississippi Kratom Consumer Protection Act, all-natural kratom would remain legal, while extracts and enhanced kratom powders may qualify as prohibited. The bill seeks to restrict kratom sales to individuals 21 years of age or older. It would ban any kratom adulterated by synthetic additives.

Additionally, the statute would outlaw the manufacturing and distribution of kratom products containing preternatural concentrations of 7-hydroxymitragynine, kratom’s terpenoid indole alkaloid. This would likely put an end to many smoke shop brands of liquid kratom extract or kratom shots.

Those who violate these statutes would face an administrative fine of $1,000 for the first offense, with a $5,000 fine for each subsequent offense. It is unclear whether such fines would extend to individuals who purchase or possess adulterated kratom. Either way, the financial penalty exists from kratom processors.

This is not particularly unreasonable on the face of it, but the law could change. The most problematic element of the Mississippi Kratom Consumer Protection Act is the vague provision offered under Section 6 of the legislation. In essence, Section 6 gives the department the authority to put into effect any changes to the law they see fit.

Should consumers be worried about such legislation? If Mac Haddow is to be taken at their word, then probably not. In a recent Tweet, Haddow writes, “The Mississippi Legislature has allowed all kratom bills to die in Committee (including the House bans and the Senate replacement KCPA).”
