Local jurisdictions are one of the few ways buying kratom in California is still illegal. The cities of San Diego and Oceanside instituted kratom bans as part of their response to the “spice” public health scare in 2016.
Both cities, however, are actively considering full or partial repeal of these bans. This would bring these cities more in alignment with current attitudes toward kratom, including momentum toward federal legislation that would legalize and regulate kratom. These cities have also been pretty lax about enforcement, given this recent study suggesting nearly half of the smoke and head shops in San Diego sell kratom.
