Is Kratom Legal in Idaho in 2024?

Idaho and potatoes go hand in hand in the Gem State. The History of the Legality of Kratom in Idaho

From coast to coast, the legalities of kratom have been a hotly debated topic since the DEA sought to add it to its list of Schedule I Controlled Substances in 2016. Fortunately for fans of Mitragyna speciosa (the scientific name for kratom), they withdrew their intention due to public outcry and pressure from kratom advocacy groups like the American Kratom Association. While this was good news for kratom enthusiasts, it did bring attention to its legality on a state-by-state level, Idaho included. In early 2020, Idaho lawmakers introduced the Kratom Truth in Labeling Act, House Bill 567. This bill sought to keep kratom legal but to impose restrictions on its sale and processing. Its key points were to:
  • Establish a minimum age for sales and possession
  • Create requirements for labeling of kratom products
  • Outlaw kratom products that have been adulterated
Idaho House Bil 567 quickly died in committee and moved no further. Although this did keep kratom legal in the state, it also allowed its sale to go completely unregulated, meaning that there’s no age restriction on who can purchase it. There are also no regulations on mandatory labeling requirements or what can be added to the product.

Idaho and the Kratom Consumer Protection Act

In 2021, Idaho lawmakers attempted to pass a law that addressed the regulation of kratom. The Kratom Consumer Protection Act (KCPA), House Bill 108, was introduced but quickly caused controversy and debate between the American Kratom Association and the Idaho Freedom Foundation. The AKA’s stance was that kratom should remain legal, but to protect those who choose to experience kratom’s benefits, the product should be regulated. They were in favor of establishing a minimum purchasing age, along with mandatory labeling requirements. However, the Idaho Freedom Foundation felt that this would lead to an increase in government control, which went against their belief in limiting the powers of government. Idaho’s Kratom Consumer Protection Act failed to pass. Kratom still remains available and unregulated within the state.
