What Is Kratom’s Legal Status in Kansas?

In 2018, Kansas lawmakers sought to ban kratom within the state and have it added to the Kansas Controlled Substances list. Due to pressure from citizens and advocacy groups, SB282 did not pass. This kept kratom legal within the state for sale and possession. However, it remained unregulated.

Kansas Kratom Consumer Protection Act (KCPA)

State lawmakers sought to keep kratom legal while also understanding the need for its regulation. Since 2020, Kansas lawmakers have attempted to pass the Kratom Consumer Protection Act. With kratom being a much-debated topic in the Sunflower State, the attempts to place restrictions and regulations on the plant have been met with resistance on both sides of the fence. In January 2023, state lawmakers introduced HB2084. This bill sought to regulate kratom by:
  • Only allowing its sale to those 21 years of age or older
  • Define kratom as a food product
  • Prohibit sales of kratom products that have been adulterated
  • Requiring labels that list recommended serving sizes and the full name and address of the manufacturer
Unfortunately, as of April 2024, the bill hasn’t passed. While this may be seen as a defeat for kratom advocacy groups, the product is still available for purchase within the state. The fight continues to keep kratom legal and regulated in Kansas.
