Is Kratom Legal in Kansas? Insights into State Laws

Pretty much smack dab in the middle of the country, Kansas is more than the place with miles and miles of wheat and cornfields that Dorothy and Toto wanted to flee. Did you know that it was illegal to serve pie with ice cream on top in the Sunflower State at one time? With such an odd law on the lawbooks at one time, you may be curious if kratom is legal in Kansas.

Let’s dive into Kansas, kratom, and its history of legality.

Kratom's legal history in Kansas.

What Is Kratom’s Legal Status in Kansas?

If you’re a kratom enthusiast residing in Kansas or thinking of visiting, you’ll be pleased to know that in 2024, kratom is perfectly legal to possess. This is great news for those who enjoy the many benefits of this botanical. However, there was a time when state lawmakers attempted to ban its sale. Kratom has been a nationwide hotly debated topic since 2016 when the DEA announced that it intended to place it on its list of Schedule I Controlled Substances. However, due to public outcry and advocacy groups like the American Kratom Association (AKA), they changed their decision two months after their announcement. If the DEA had followed through, kratom would have become illegal from coast to coast. In 2018, Kansas lawmakers sought to ban kratom within the state and have it added to the Kansas Controlled Substances list. Due to pressure from citizens and advocacy groups, SB282 did not pass. This kept kratom legal within the state for sale and possession. However, it remained unregulated.

Kansas Kratom Consumer Protection Act (KCPA)

State lawmakers sought to keep kratom legal while also understanding the need for its regulation. Since 2020, Kansas lawmakers have attempted to pass the Kratom Consumer Protection Act. With kratom being a much-debated topic in the Sunflower State, the attempts to place restrictions and regulations on the plant have been met with resistance on both sides of the fence. In January 2023, state lawmakers introduced HB2084. This bill sought to regulate kratom by:
  • Only allowing its sale to those 21 years of age or older
  • Define kratom as a food product
  • Prohibit sales of kratom products that have been adulterated
  • Requiring labels that list recommended serving sizes and the full name and address of the manufacturer
Unfortunately, as of April 2024, the bill hasn’t passed. While this may be seen as a defeat for kratom advocacy groups, the product is still available for purchase within the state. The fight continues to keep kratom legal and regulated in Kansas.

Kratom FAQs

What Is Kratom? Where Does it Come From?

Kratom, scientifically known as Mitragyna speciosa, is a tropical evergreen tree native to Southeast Asia. Growing as tall as 80 feet, the tree’s leaves have been chewed or brewed as tea by indigenous people for ceremonial use and as a productivity aid, mainly by farmers, fishermen, and others with labor-intensive jobs. Now popular in the Western world, kratom is available as powders, extracts, gummies, and capsules.

How Is Kratom Made?

It’s the leaves of the kratom tree that provide the benefits that kratom fans seek, namely, the alkaloids that they contain. First, its leaves are harvested at different times, depending on the alkaloid mix the cultivators seek. Mature leaves, known for their red veins, are more mature than those with white or green veins.

Once the leaves are harvested, they must be dried. Drying is done by laying them out and letting them dry in the sun or within controlled indoor drying facilities. Once dried, the leaves are ground into a fine powder and packaged for sale or further processing.
