New York’s Kratom Laws: Navigating the Legal Landscape

You may have heard of or even tried some kratom in the past, but before you go out and buy it on your own, you need to know if it’s legal in New York. The short answer is yes, kratom is legal throughout the entire state of New York including all of the state’s many cities, counties, and other locations. You can possess, buy, sell, and transport kratom freely throughout this state with no restrictions.

 

The History of Kratom’s Legality in New York

New York’s history with kratom legislation began in 2017. During this time, the state introduced several proposed bills. One bill, New York Assembly Bill 8787 aimed to prohibit the sale of kratom to anyone under the age of 18. This bill wanted to impose a “civil penalty of no more than five hundred dollars” for those selling kratom to minors. New York Senate Bill 6924, another piece of legislation aimed at kratom wanted to achieve the same goal of banning kratom sales to anyone under 18. However, neither bill made it through committee.

There was an attempt to outlaw kratom through Assembly Bill 231. This legislation aimed to completely prohibit “the sale or distribution” of kratom throughout New York. Fortunately, this bill died in committee and didn’t pass. 

 

Is There Any Pending Kratom Legislation in NY?

There’s only one current piece of pending kratom legislation in New York. This bill, Assembly Bill A294 wants to prohibit the sale of kratom to anyone under the age of 21. It’s unknown if this bill will pass committee and move on to New York’s on-floor calendar. 

 

Will New York Ever Ban Kratom?

Unfortunately, it’s impossible to say. While many consumers and government officials realize this plant’s benefits, others could attempt to ban kratom in New York in the future. As of now, there is no legislation in place to ban the sale or possession of kratom in New York. There’s also the possibility of kratom facing a wave of regulation regarding how companies produce, distribute, and sell this plant. 

 

New York and the Kratom Consumer Protection Act

Another important piece of legislation New York is trying to pass, but hasn’t yet, is the state’s version of the Kratom Consumer Protection Act (KCPA). This act, developed in coordination with the American Kratom Association (AKA) and first passed by Utah, aims to make the kratom industry more secure for consumers and businesses.

The KCPA aims to regulate the production and distribution of kratom and has now been introduced at the federal level. This act also wants to prohibit minors from being able to buy or possess kratom. It also calls for kratom product testing and labeling.

At this time, the following states passed some form of the KCPA:

  • Arizona
  • Nevada
  • Oklahoma
  • Utah
  • Georgia
  • Colorado
  • Oregon
  • Texas
  • Florida
  • Virginia
  • West Virginia
