Know the Basics of Nevada Kratom Laws

Yes, kratom is currently legal in Nevada. However, as we cover below, this state continues to face opposition to kratom from certain parties. Thankfully, pro-kratom individuals, companies, and organizations throughout Nevada continue fighting to keep kratom legal in Nevada. While kratom is currently legal in Nevada, a few previous close calls almost eliminated the right to use, transport, possess, or sell kratom legally in this state. Here’s a closer look at the fight for and against kratom in Nevada.

 

The Nevada Kratom Consumer Protection Act

In April 2019, the American Kratom Association (AKA) proposed the Nevada Kratom Consumer Protection Act (KCPA). While each state has slightly different laws and regulations, Nevada’s KCPA (Assembly Bill 303) proposed:

• Prohibiting the sale of kratom to anyone under 18 years old
• Banning the sale or distribution of any adulterated kratom product
• Stopping the sale of kratom without proper labeling

A few months later, in June 2019, the state passed the Nevada Kratom Consumer Protection Act. This historic vote made Nevada the fourth state to enact a version of the KCPA. If found guilty of violating any of Nevada’s KCPA rules, this person could face a fine of up to $1,000.

As recently as March 2022, Nevada faced continued opposition from groups, including the Nevada State Board of Pharmacy. This state board announced an upcoming public hearing to move kratom to Nevada’s list of Schedule I controlled substances in 2022. Thankfully, overwhelming public support from pro-kratom organizations and individuals led to the Nevada State Board of Pharmacy calling off this meeting to seek a ban on kratom.

 

Assembly Bill 322

In March 2023, a group of lawmakers in Nevada created Assembly Bill 322. AB322 aimed to prohibit anyone from preparing, distributing, selling, or advertising kratom products unless they register their product with Nevada’s State Board of Oriental Medicine. Fortunately, the governor of Nevada vetoed this legislation.

 

Will Kratom Remain Legal in Nevada?
